I never would have predicted the drama of what is likely to be an epic showdown where the NCAA actually fights for its credibility, if not its existence. UNC-CH has pushed all of its chips in and could not be more defiant, seemingly eliminating the chance for a moderate outcome where hands would be slapped. In a strange twist, it is being reported that Kenneth Wainstein, the author of the second report on the Tar Heels fraud has been interviewed for the FBI Director position. If appointed, would he be available to testify before the NCAA? How would that impact this case? His report has the supporting evidence so maybe it is no big deal, but it is untimely.

His report has the supporting evidence so maybe it is no big deal, but it is untimely.[/quote] I’m not sure I understand how UNC-Cheat can argue the lack of institutional control charge, it’s clearly a systems failure that this went on so long and to such a severe degree, if that doesn’t apply then none of the NCAA bylaws apply. If they get off in court, then the blue print for every other blue blood is in place to cheat with abandon, and then say the NCAA has no jurisdiction. I agree that this is going to undermine NCAA authority completely if UNC-Cheat doesn’t end up with harsher penalties now.

On a side note: It’s amazing that every single time I’ve come across a N&O article on the Cheats, there are 30 - 50 comments defending the cheating by that same guy, Jeff Franklin. He appears to be a one-person troll army, wonder if he’s paid to do it by someone associated with the Cheats.

If Cheat’s argument is that the NCAA only has jurisdiction over athletics and not over academics, then does it not follow that Cheat does not consider its athletes to be students? What am I missing here? Seems truly Orwellian to me.
